Former Oregon tight end Spencer Webb’s family is questioning Instagram model Kelly Kay’s claim that he is the father of her newborn child.
Kay gave birth to a son named Spider in late March and named him after Webb, who died in a diving accident last July.
Webb’s older brother, Cody, issued a statement to the Sacramento Bee saying their family hoped Kay would take a DNA test to confirm the baby’s paternity, but that she “didn’t want to compromise”.

“Our family has been trying to focus on our grieving process since the passing of our brother, son and cousin. We grieve both individually and as a family as we try to cope with this tragedy. In the first hours after Spencer’s passing, and just days after they met, Kelly started talking about the possibility of being pregnant,” the Webb family said in a statement to the outlet.
“Since Spencer can’t handle this situation on her own, we’ve tried to navigate this sensitive space as a family. That being said, our family has doubts and concerns about the paternity of this child for several reasons. So far, we’ve kept quiet in hopes that a DNA test would confirm that Spencer is the father.
“Unfortunately, Kelly is unwilling to compromise on the way the DNA test is administered. Since we could not agree on an appropriate DNA collection process, we wanted to provide an explanation and timeline to help provide the family’s perspective on these circumstances.”


The statement included a timeline claiming that Kay’s first contact with Spencer Webb occurred 16 days before he died, and that the two first met in person less than a week before the accident.
The statement also said they could not reach an agreement on the parameters of the paternity test, including the Webb family’s desire for it to be conducted in a “neutral” location, with someone from their side present.
Kay refuted the claims on several Instagram Stories posted on Friday, saying that she had indeed already been given a test and that Spencer is definitely Spider’s father.

“There are two sides to every story and there’s a lot of family drama that I shouldn’t even bring up, it’s nobody’s business,” Kay said in an Instagram story. “I try not to publicize my late baby daddy’s family drama like that.
“I have great relationships with Spencer’s mother and sisters. I worked with Spencer’s mother and a lawyer to get a legal DNA test to get Spencer’s name on the birth certificate. … We did, me and his mother, and Spider did the DNA test.
“Obviously it’s his kid. You can look at him and see it’s his kid.”

Kay also noted that Cody, who is Webb’s stepbrother on his father’s side, is the one who held back the DNA test, though Kay says she was able to get it through Webb’s mother.
“Spencer’s brother, who can’t even give a DNA test because he’s not his full brother, is trying to get me,” she said. “That side of the family has been awful to me throughout my pregnancy and throughout this process.
“His mother’s side has been amazing and supportive and amazing. It’s his brother from his father’s side, who knocked Spencer out when he was 18 when he left him and didn’t like him and had issues with him, is the one that comes before me.
Kay also wrote that she would sue for libel and get a protection order.
